Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Playbook, a career intelligence platform operated by McMillian Media LLC ("we," "us," or "our"). By creating an account or using any part of the platform, you agree to these Terms. If you do not agree, do not use the platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use The Playbook. By using the platform you represent that you meet these requirements.

2. Beta Access

The Playbook is currently in beta. Beta access is provided by invitation or waitlist approval. We may change, limit, or revoke beta access at any time without notice. Beta features are provided "as is" and may change significantly before general availability.

3. Your Account

You are responsible for keeping your login credentials secure. You may not share your account with others. You must notify us immediately at hello@buildmyplaybook.app if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized account use.

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to circumvent usage limits, plan restrictions, or authentication controls
• Reverse engineer, decompile, or extract proprietary algorithms or AI models from the platform
• Use automated bots, scrapers, or scripts to access the platform without written permission
• Submit content designed to manipulate, deceive, or extract unintended responses from our AI systems (prompt injection)
• Resell, sublicense, or redistribute platform outputs as a competing service

5. AI-Generated Content Disclaimer

The Playbook uses artificial intelligence to generate career research, company analysis, interview preparation content, and related materials. You acknowledge and agree that:

• AI-generated content may contain inaccuracies, errors, or outdated information
• All content generated by The Playbook must be independently verified before use in job applications, interviews, or professional communications
• We make no warranty that generated content is accurate, complete, current, or suitable for any particular purpose
• You assume full responsibility for how you use AI-generated content

We will display an AI disclosure label on all generated content. This is in compliance with applicable consumer protection guidance regarding AI-generated material.

6. Data You Provide

By uploading your resume, career documents, LinkedIn profile data, or other materials, you grantMcMillian Media LLC a non-exclusive, royalty-free license to process and use that data solely for the purpose of providing the The Playbook service to you. We do not sell your personal data or career documents to third parties. See our Privacy Policy for details.

7. Intellectual Property

The The Playbook platform, including its software, design, and proprietary AI prompts, is owned byMcMillian Media LLC. You retain ownership of the documents and data you submit. AI-generated outputs are provided to you for personal use; we do not claim ownership of outputs generated specifically for your account.

8. Third-Party Services

The Playbook uses third-party services including Anthropic (AI generation), Supabase (database and authentication), and others. Your use of these services through our platform is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of these third parties.

9. Limitation of Liability

To the maximum extent permitted by law, McMillian Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of employment opportunities, lost profits, or reputational harm, arising from your use of or reliance on The Playbookor its AI-generated content. Our total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Disclaimer of Warranties

The Playbook is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee uninterrupted or error-free service.

11. Termination

We may suspend or terminate your access to The Playbook at any time, with or without notice, if we reasonably believe you have violated these Terms. You may delete your account at any time from your Settings page. Upon termination, your right to use the platform immediately ceases.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notice before material changes take effect. Continued use of The Playbook after the effective date constitutes acceptance of the updated Terms.
